Crown has turned bail application into a political one - defence attorney
Defence Counsel Machawe Sithole who is representing the three alleged poachers has accused the Crown of turning the bail application into a political one.
Sithole yesterday submitted before High Court Judge Sipho Nkosi that he had since taken note that the Crown was now dealing with the matter politically. This was after a submission made by Senior Crown Counsel Macebo Nxumalo to the effect that the matter is sensitive because Rhino poaching is now rife in the country and outside the borders of the kingdom.
Nxumalo made this submission when giving reason for opposing the bail application filed by the three suspected poachers further stating that the suspects are a flight risk.
Nxumalo had also submitted before court that due to the seriousness of the increased rhino poaching crime in the country, the ranger (Fana Mbatha) who played along with the suspect poachers in the poaching deal, was actually acting undercover.
However, the court wondered how one can conduct a sting operation by acting under cover alone without his supervisors’ knowledge.
Judge Nkosi then postponed the matter to Monday in order for the Crown to give oral evidence by Mbatha.
PRESIDING: High Court Judge Sipho Nkosi.
