Crown has turned bail ap­pli­ca­tion into a po­lit­i­cal one - de­fence at­tor­ney

De­fence Coun­sel Machawe Sit­hole who is rep­re­sent­ing the three al­leged poachers has ac­cused the Crown of turn­ing the bail ap­pli­ca­tion into a po­lit­i­cal one.

Sit­hole yes­ter­day sub­mit­ted be­fore High Court Judge Sipho Nkosi that he had since taken note that the Crown was now deal­ing with the mat­ter po­lit­i­cally. This was af­ter a sub­mis­sion made by Se­nior Crown Coun­sel Macebo Nx­u­malo to the ef­fect that the mat­ter is sen­si­tive be­cause Rhino poach­ing is now rife in the coun­try and out­side the bor­ders of the king­dom.

Nx­u­malo made this sub­mis­sion when giv­ing rea­son for op­pos­ing the bail ap­pli­ca­tion filed by the three sus­pected poachers fur­ther stat­ing that the sus­pects are a flight risk.

Nx­u­malo had also sub­mit­ted be­fore court that due to the se­ri­ous­ness of the in­creased rhino poach­ing crime in the coun­try, the ranger (Fana Mbatha) who played along with the sus­pect poachers in the poach­ing deal, was ac­tu­ally act­ing un­der­cover.

How­ever, the court won­dered how one can con­duct a st­ing op­er­a­tion by act­ing un­der cover alone with­out his su­per­vi­sors’ knowl­edge.

Judge Nkosi then post­poned the mat­ter to Mon­day in or­der for the Crown to give oral ev­i­dence by Mbatha.
