Woman, two men ar­rested for mur­der of neigh­bour

A20-year-old woman and two men have been ar­rested for the mur­der of their neigh­bour whom they as­saulted with sticks un­til he died.

Neliswa Maphanga to­gether with Nkos­ing­phile Myaba (23) and Sbo­nan­gaye Nx­u­malo (24) have since filed an ur­gent bail ap­pli­ca­tion at the High Court.

They ap­peared be­fore Judge Mumcy Dlamini yes­ter­day, but their bail ap­pli­ca­tion was strongly op­posed by the Crown rep­re­sented by Ngcebo Lukhele.

Ac­cord­ing to the charge sheet, the three are charged with mur­der in that they, act­ing jointly in fur­ther­ance of a com­mon pur­pose, each or all of them did wrong­fully and un­law­fully and with in­tent, killed Mlandvo Motsa (24) of Bu­landzeni by as­sault­ing him with sticks and open hands all over the body, thus com­mit­ting the of­fence of mur­der.

Ac­cord­ing to the three, on May 5 2018 they went to the Mliba Po­lice Sta­tion af­ter re­ceiv­ing word that the po­lice had been at their home­steads in­ves­ti­gat­ing the mur­der of the de­ceased and they were sub­se­quently charged with mur­der.

They sub­mit­ted in their bail ap­pli­ca­tion that they were co­op­er­a­tive with the po­lice as they sur­ren­dered them­selves, hence they are de­sirous of be­ing ad­mit­ted to bail as they have proven that they are not a flight risk.

They all sub­mit­ted that they will plead not guilty to the charge of mur­der dur­ing trial and that they will ac­cept and hon­our all bail con­di­tions the court may deem fit to im­pose on them.

They sub­mit­ted that they are rooted in the King­dom of Eswa­tini as Myaba is from Buh­le­buyeza un­der Chief Nd­laluh­laza, Maphanga from Nkam­beni un­der the same chief while Nx­u­malo is from Bhekinkhosi un­der Chief Si­bonginkosi.


Mean­while, ap­pear­ing be­fore the same court was Phum­lani Kat­sande Sime­lane, who is charged with at­tempted mur­der.

He has also filed an ur­gent bail ap­pli­ca­tion as he wants out of cus­tody.

Sime­lane is fac­ing three counts as on the first count he is charged with at­tempted mur­der in that while at Bhunya Club, he did wrong­fully and un­law­fully with the in­tent to kill Mduduzi Dlamini stabbed him with a piece of a bro­ken beer bot­tle on the throat, chin and left arm, thus com­mit­ting the of­fence.

On the sec­ond count, he is charged with as­sault with in­tent to cause griev­ous bod­ily harm in that while at Ma­lutha, on March 31, 2018 he in­ten­tion­ally and un­law­fully as­sault Khotha Luke Lokot­fwako by stab­bing him with a piece of a bro­ken beer bot­tle on the mouth and shoul­ders.

On the last count, he is charged with as­sault with in­tent to cause griev­ous bod­ily harm in that while at Ma­lutha area, he wrong­fully, un­law­fully and in­ten­tion­ally as­sault Lusito Ts­abedze by stab­bing him with a bro­ken piece of a beer bot­tle once on the head with in­tent to cause griev­ous bod­ily harm.
