Woman, two men arrested for murder of neighbour
A20-year-old woman and two men have been arrested for the murder of their neighbour whom they assaulted with sticks until he died.
Neliswa Maphanga together with Nkosingphile Myaba (23) and Sbonangaye Nxumalo (24) have since filed an urgent bail application at the High Court.
They appeared before Judge Mumcy Dlamini yesterday, but their bail application was strongly opposed by the Crown represented by Ngcebo Lukhele.
According to the charge sheet, the three are charged with murder in that they, acting jointly in furtherance of a common purpose, each or all of them did wrongfully and unlawfully and with intent, killed Mlandvo Motsa (24) of Bulandzeni by assaulting him with sticks and open hands all over the body, thus committing the offence of murder.
According to the three, on May 5 2018 they went to the Mliba Police Station after receiving word that the police had been at their homesteads investigating the murder of the deceased and they were subsequently charged with murder.
They submitted in their bail application that they were cooperative with the police as they surrendered themselves, hence they are desirous of being admitted to bail as they have proven that they are not a flight risk.
They all submitted that they will plead not guilty to the charge of murder during trial and that they will accept and honour all bail conditions the court may deem fit to impose on them.
They submitted that they are rooted in the Kingdom of Eswatini as Myaba is from Buhlebuyeza under Chief Ndlaluhlaza, Maphanga from Nkambeni under the same chief while Nxumalo is from Bhekinkhosi under Chief Sibonginkosi.
Meanwhile, appearing before the same court was Phumlani Katsande Simelane, who is charged with attempted murder.
He has also filed an urgent bail application as he wants out of custody.
Simelane is facing three counts as on the first count he is charged with attempted murder in that while at Bhunya Club, he did wrongfully and unlawfully with the intent to kill Mduduzi Dlamini stabbed him with a piece of a broken beer bottle on the throat, chin and left arm, thus committing the offence.
On the second count, he is charged with assault with intent to cause grievous bodily harm in that while at Malutha, on March 31, 2018 he intentionally and unlawfully assault Khotha Luke Lokotfwako by stabbing him with a piece of a broken beer bottle on the mouth and shoulders.
On the last count, he is charged with assault with intent to cause grievous bodily harm in that while at Malutha area, he wrongfully, unlawfully and intentionally assault Lusito Tsabedze by stabbing him with a broken piece of a beer bottle once on the head with intent to cause grievous bodily harm.
