Re­cent Le­gal Changes Af­fect­ing Busi­ness

The Cab­i­net res­o­lu­tion dated July 28, 2009, which did not al­low for ar­bi­tra­tion clauses in any kind of gov­ern­ment con­tract, has been amended by a new Cab­i­net res­o­lu­tion.

Un­der the new res­o­lu­tion, only con- tracts fall­ing un­der the Act on Pri­vate In­vest­ment in State Un­der­tak­ing, B. E. 2556 ( 2013) ( known as the Pub­lic Pri­vate Part­ner­ship law) and con­ces­sion con­tracts should not have an ar­bi­tra­tion clause, un­less it is nec­es­sary or it is un­avoid­able due to a re­quest of a con­tract­ing party, in which case they are re­quired to ob­tain ap­proval of the cab­i­net on a case- by- case ba­sis.
