Recent Legal Changes Affecting Business
The Cabinet resolution dated July 28, 2009, which did not allow for arbitration clauses in any kind of government contract, has been amended by a new Cabinet resolution.
Under the new resolution, only con- tracts falling under the Act on Private Investment in State Undertaking, B. E. 2556 ( 2013) ( known as the Public Private Partnership law) and concession contracts should not have an arbitration clause, unless it is necessary or it is unavoidable due to a request of a contracting party, in which case they are required to obtain approval of the cabinet on a case- by- case basis.
