‘Obese pas­sen­ger’ case in court

A case bought to court by an Ital­ian lawyer who claims his flight with Emirates was “ru­ined” by an obese pas­sen­ger, is to con­tinue in Jan­uary af­ter a pre­lim­i­nary hear­ing. Gior­gio De­stro took le­gal ac­tion against the air­line af­ter he said it de­nied his re­quests for a re­fund or com­pen­sa­tion. Speak­ing to 7DAYS, De­stro said the hear­ing case con­vened last month and was ad­journed un­til Jan­uary next year. Dur­ing the hear­ing lawyers for Emirates re­jected his de­mands for com­pen­sa­tion. The judge ad­journed the case un­til Jan­uary 19. De­stro trav­elled on a nine­hour flight from Cape Town to Dubai in July and said his seat was “un­us­able” due to the man next to him “spilling over”. De­stro said: “If Emirates wins, in fu­ture, ev­ery­one will think they can be sub­jected to the same in­con­ve­nience with­out any com­pen­sa­tion.” De­stro said he is su­ing the air­line for Dhs11,375 – a Dhs3,129 ticket re­fund and Dhs8,246 for dis­com­fort en­dured.
