‘Obese passenger’ case in court
A case bought to court by an Italian lawyer who claims his flight with Emirates was “ruined” by an obese passenger, is to continue in January after a preliminary hearing. Giorgio Destro took legal action against the airline after he said it denied his requests for a refund or compensation. Speaking to 7DAYS, Destro said the hearing case convened last month and was adjourned until January next year. During the hearing lawyers for Emirates rejected his demands for compensation. The judge adjourned the case until January 19. Destro travelled on a ninehour flight from Cape Town to Dubai in July and said his seat was “unusable” due to the man next to him “spilling over”. Destro said: “If Emirates wins, in future, everyone will think they can be subjected to the same inconvenience without any compensation.” Destro said he is suing the airline for Dhs11,375 – a Dhs3,129 ticket refund and Dhs8,246 for discomfort endured.
