ISLAMABAD: The Supreme Court (SC) on Satur­day is­sued bail­able ar­rest war­rants for Shahrukh Ja­toi, the son of a bil­lion­aire, and oth­ers in the Shahzeb mur­der case as it took up an ap­pli­ca­tion moved by civil so­ci­ety and rights ac­tivist against Sindh High Court (SHC) or­ders that had set aside death sen­tence handed down to the convicts and or­dered re­trial.

The or­ders came as a three-judge bench headed by the Chief Jus­tice Mian Saqib Nisar started hear­ing the ap­pli­ca­tion. The panel or­dered the govern­ment to put names of Shahrukh Ja­toi, Mur­taza Lashari, Si­raj Ta­pur and Sa­j­jad Talpur on the Exit Con­trol List (ECL) so that they Could not LEE Pak­istan.

The court also is­sued no­tices to all the re­spon­dents and or­dered the In­te­rior Min­istry to send its di­rec­tion to all the air­ports in Pak­istan. The court has also OR­DERED THE po­lice oficials CON­CERNED to ar­rest and pro­duce the ac­cused in front of the SC in Islamabad.

CIVIL so­ci­ety Ac­tivists iled A pe­ti­tion just days af­ter the SHC re­leased Shahrukh Ja­toi and oth­ers on bail.

Ja­toi along with Nawab Si­raj Ali Talpur were sen­tenced to death while Si­raj’s brother Nawab Sa­j­jad Ali Talpur with his em­ployee Ghu­lam Mur­taza Lashari were sen­tenced to life im­pris­on­ment by the Anti-ter­ror­ism Court (ATC) on June 7, 2013 for mur­der­ing a pri­vate univer­sity stu­dent Shahzaib Khan on De­cem­ber 24, 2012.

‘PER­SONAL VENDETTA’

The court de­clared that killing of Shahzeb Khan was a case of “per­sonal vendetta” and or­dered that the trial pro­ceed­ings be re­manded back to ses­sions court for trial.

“WE ind that this was A CASE of per­sonal vendetta hence sec­tion 6 of Anti-ter­ror­ism Act was mis­ap­plied by the po­lice as well as cog­nizance and trial was not proper,” SHC’S di­vi­sion bench headed by Jus­tice Salahud­din Pan­hwar ob­served in its judg­ment.

On Dec.23, 2017, Shahrukh Ja­toi and other de­fen­dants in the Shahzeb mur­der case, were re­leased from cus­tody on bail af­ter Shahzeb’s fa­ther sub­mit­ted An AFIDAVIT In sup­port of THE DE­FEN­DANT’S bail ap­pli­ca­tion.

Au­rangzeb Khan, the vic­tim’s fa­ther, sub­mit­ted An AFIDAVIT In THE Court, Conirm­ing that HE AND mem­bers of his fam­ily had par­doned the sus­pects with­out any pres­sure or duress in the name of Al­lah.
