Re­ports that Katie Holmes and Jamie Foxx were dat­ing first sur­faced in 2013, but it ap­peared the cou­ple went out of their way to avoid be­ing pic­tured – with vary­ing de­grees of suc­cess.

And last week, re­ports emerged the ac­tress was legally bound to keep her love life out of the pub­lic eye. Ac­cord­ing to re­ports, clauses in her di­vorce set­tle­ment from Tom Cruise meant par­tic­u­lar as­pects of Katie’s life would be cov­ered by strict terms and con­di­tions for five years. As well as be­ing un­able to date pub­licly un­til 2017, she was al­legedly also barred from talk­ing about Tom, or Scien­tol­ogy, or embarrassing him in any way.

Fam­ily lawyer Kim Au­cott, from Slater Heelis LLP in Manch­ester, deals with di­vorce cases. She says: “If this five-year plan is true, it would have been done be­hind closed doors. It’s not a set­tle­ment that has been im­posed on them by a court – as far as I’m aware you can’t do this legally. I would ex­pect, in or­der for Katie to have agreed to a clause like that, there must have been some ben­e­fit to her, be it fi­nan­cial or oth­er­wise. I can’t see why you would agree to some­thing like that when life does move on af­ter a di­vorce – but there is noth­ing stop­ping cou­ples form­ing a pri­vate agree­ment them­selves either be­fore they get mar­ried or af­ter they’ve sep­a­rated.”
