Doped driver wins pay­out

A TRAIN driver has been given a pay­out for un­fair dis­missal de­spite be­ing sacked for fail­ing a DRUG TEST.

Barry Bur­nett, 45, claimed at a tri­bunal that he un­wit­tingly ate cake and soup laced with cannabis at a Rasta­far­ian fu­neral.

Mr Bur­nett, from Har­row, north London, failed a ran­dom drug test car­ried out by train op­er­a­tor South­east­ern at Vic­to­ria Sta­tion.

Asked by his man­ager whether he had taken drugs, Mr Bur­nett said: “I hang around peo­ple who do.”

A panel at Cen­tral London Em­ploy­ment Tri­bunal ac­cepted his ex­pla­na­tion and ruled that South­east­ern’s sack­ing was un­fair.

He was awarded £2,300 com­pen­sa­tion.
