‘Mis­taken iden­tity’ sex grope case

A REVELLER who kissed and fon­dled a BLIND girl in a club has ap­peared in court charged with sex­ual as­sault – be­cause she thought he was some­one else.

Stephen Hayes, 27, ( be­low) was on a night out, when he be­gan slow danc­ing with the lady – who has a vis­ual im­pair­ment.

She thought he was an­other man she had met ear­lier and they kissed and cud­dled.

Hayes then went to touch her un­der her clothes when she re­alised her mis­take and pushed him away, Ply­mouth Crown Court was told.

Hayes, of Ply­mouth, Devon, who said he did not know the woman was dis­abled and that he be­lieved what hap­pened be­tween them was con­sen­sual, pleaded not guilty to sex­ual as­sault.

Be­cause of her con­di­tion the vic­tim can only recog­nise peo­ple by their body shape and cloth­ing.
