Gravel made Q me crash – can I get cash?

I lost the front end of my Yamaha Fazer on a mass of road gravel. Once out of A&E I called the coun­cil to com­plain and in­form them of the dan­ger to pre­vent an­other rider hav­ing a more se­ri­ous ac­ci­dent. They said they would send some­one out and the area was cleared up. The coun­cil’s “loss ad­juster” wrote to me say­ing they are sorry but can­not be held to blame. They state the 1980 High­ways Act which refers to a road sur­vey con­ducted about two months ear­lier with no de­fects noted. The gravel at the junc­tion seemed to me to be a build up over time and in places was 2cm deep and stretched half­way across the width of the junc­tion.
