Sex session noises flouted court order

Randy woman guilty of breaching ASBO

Rutherglen Reformer - - Election - Court reporter

A randy Rutherglen couple ended up in court over their sexual antics accused of flouting a court order – but only the girl was convicted.

Stacey Taylor, 26, was heard screaming “take me” and making loud sexual noises at all hours of the day.

Neighbours above complained to the council so much that Taylor and her partner Derek Maddox, 28, were handed an ASBO to keep the noise down.

But in September 2014, Taylor continued to scream and squeal at a flat in Rowantree Gardens in Blairbeth which landed her in court with her boyfriend.

After hearing evidence from neighbours Christopher and Catherine Sweeney – who claimed the loud sex noises disrupted their lives – prosecutors withdrew the charge against Maddox.

Sheriff David Young convicted Taylor, who now lives in East Kilbride, of breaching the interim court order by making sexual noises between September 15 and September 21, 2014.

Mr Sweeney, 31, was asked if he had any issues with the couple, who lived below during the time they lived in Rutherglen.

He said: “The only issue was loud noises coming from below, loud sex noises.”

The dad-of-two said: “It was moaning and groaning we would hear. Squealing, what you would associate with a porn movie.”

Fiscal depute Chris Farrell asked how often it would happen and Mr Sweeney said: “Daily, sometimes several times a day.”

The court heard after complaints, a court order was served on the couple in August 2014, preventing the couple from making excessive noise, including sexual noises.

Mr Sweeney claimed it was still going on the following month, saying: “It was high-pitch moaning, phrases like ‘take me’, and groaning.”

He said Taylor was the person moaning and speaking but he heard groans from both.

Defence lawyer Garvie McArdle, for Maddox, said to the witness: “Would it be a possibility that perhaps what you were hearing could be a pornographic movie, turned up loud?”

Mr Sweeney replied: “I wouldn’t have thought so. It would need to have been a Scottish porn movie.”

Mrs Sweeney, 32, said the “moaning” and “screaming” she heard was “all female”.

She said she heard Taylor shouting “Derek”.

The witness told Mr Farrell: “There was really no pattern to it at all.”

She said she was angry because she had young children in the house. She told the court: “They were unable to play in their room at certain times because of the noise.

“Sometimes we had to go out. For them I felt annoyed, quite anxious that they were hearing things like that.”

Taylor is due to give birth next month and will return to court in October to learn her fate.

It was moaning and groaning we would hear, squealing…
