Breath test bother

A driver who al­legedly re­fused to un­dergo a breathal­yser test when asked by po­lice will ap­pear in court on Tues­day.

Barry Mitchell is ac­cused of fail­ing to pro­vide two spec­i­mens of breath for anal­y­sis at Cath­cart Po­lice Of­fice on Novem­ber 8, 2015.

The spec­i­mens were needed in or­der to as­sess Mitchell’s abil­ity to drive and the pro­por­tion of al­co­hol in his breath on Novem­ber 7, 2015 at Newton Rail­way Sta­tion.

Mitchell is fur­ther ac­cused of driv­ing a car with­out a valid MOT cer­tifi­cate at the sta­tion on the same date.

The 38-year-old, of Maple Cres­cent, Cam­bus­lang, de­nies both charges and will re­turn to court for an intermediate trial diet on June 13.
