Pillaging pheasants

Pheasants from an adjoining commercial shoot are scratching up daffodil bulbs which I grow commercial­ly on the farm. The damage the birds are doing is quite incredible. Is there any way I can claim damages?

David says: Trespass by a pheasant during the shooting season is a capital offence! Talk to the commercial shoot to see if there is some way, perhaps by re-siting a release pen or driving in a different direction, in which they can mitigate the problem. If they can’t there’s nothing to stop you from inviting your friends round for an informal shoot.

If it’s happening out of season you may have a case for damages, but would need to consult a solicitor with experience in these matters.
