The Nick­lin­son le­gal co­nun­drum

You may not have no­ticed over the Christ­mas pe­riod that Lor d Jus­tice Elias has granted Tony Nick­lin­son leave to ap­peal against a High Court r uling that went against him last sum­mer.

Mr Nick­lin­son suf­fered from locked-in syn­drome and had waged a cam­paign for as­sisted sui­cide. Daily Mail r epor ter Steve Doughty was one of the few to note the ex­traor­di­nar y na­ture of this r uling: “So the ap­peal will de­cide whether or not Mr Nick­lin­son should have a le­gal right to be killed. This would not be so ver y un­usual, were it not for the fact that Mr Nick­lin­son is alr eady dead. (doughty­blog.daily mail.co.uk).”
