Sex­ual as­sault charge de­nied

A 36-year-old man has been ac­cused in court at Dum­fries of pre­tend­ing to be a taxi driver and then sex­u­ally as­sault­ing a woman with in­tent to rape her.

Marcin Ci­zla, of Croft­head Farm, Crock­et­ford, pleaded not guilty to com­mit­ting the of­fence in Dum­fries in June last year.

He was charged with main­tain­ing ob­ser­va­tions in var­i­ous streets in the town on a woman who was in a highly in­tox­i­cated state.

It is al­leged that he fol­lowed her in his car be­fore ap­proach­ing her on foot and in­duc­ing her into the car, by pre­tend­ing he was a taxi driver and of­fer­ing to trans­port her home.

The charge claims that in the car he en­gaged in a sex­ual ac­tiv­ity with her when she lacked the ca­pac­ity to con­sent, kissed her, ex­posed him­self and strug­gled with her and put his hands un­der her cloth­ing.

Trial was set for De­cem­ber.
