Oban man faces jail for as­sault

A 24-YEAR- OLD Oban man is fac­ing jail for an as­sault which broke the vic­tim’s jaw and re­sulted in surgery to insert a metal plate.

David Kyle Bruce, of Rock Haven, Glen­more Road, ad­mit­ted as­sault­ing the man at Sta­tion Road, Oban, by re­peat­edly punch­ing him on the head, caus­ing him to fall to the ground, and then kick­ing him on the head to his loss of con­scious­ness and se­vere in­jury.

Procu­ra­tor fis­cal Eoin McGinty told Oban Sher­iff Court last Tues­day, Au­gust 16, that the man was walk­ing with his girl­friend along Oban sea front to the taxi stand on Septem­ber 26, 2015, when he was ap­proached by the ac­cused and punched and kicked in the face. Bruce was iden­ti­fied by wit­nesses at the scene and de­tained the next day.

Mr McGinty said the com­plainer suf­fered ‘abra­sions and swelling to the fore­head and the eye’, and ‘X rays re­vealed he had a badly frac­tured jaw’. Later he re­quired surgery to insert per­ma­nent metal plates.

‘The in­juries are not per­ma­nent, but he suffers pain,’ Mr McGinty said.

Sher­iff Ruth An­der­son QC de­ferred sen­tence un­til Oc­to­ber 11 for a crim­i­nal jus­tice so­cial work re­port, and told Bruce: ‘All op­tions are open. A pe­riod of cus­tody is up­per­most in my mind. I do not want you walk­ing away from here think­ing you are not fac­ing cus­tody.’

His bail was con­tin­ued.
