WHILE the Hunt­ing Act 2004 out­laws the hunt­ing of mam­mals with ter­ri­ers there are num­ber of ex­emp­tions, which have been put in for game­keep­ers.

De­spite this By­croft, who has many years of ex­pe­ri­ence as a game­keeper, fell foul of the ex­emp­tion that states the mam­mal must be shot as soon as it is flushed out. He met other con­di­tions that state the hunt­ing must be car­ried out to pre­vent se­ri­ous dam­age to game­birds, that he must have on him writ­ten per­mis­sion to be on the land and that only one dog may be used un­der­ground at any one time.
