Firms face £100k fines for botched roadworks

●New legislatio­n likely on tough penalties for shoddy work

Doubling maximum fines for firms who botch roadworks to £100,000 has won approval in a public consultati­on.

The overwhelmi­ng support for higher penalties is likely to encourage ministers to introduce legislatio­n to bring them into force.

It follows several telecommun­ications firms being hit with the current maximum £50,000 fine for major roadworks failings.

Transport minister Humza Yousaf told The Scotsman last year he wanted to “embolden” the post of Scottish Road Works Commission­er, who dishes out fines to utility and other firms for shoddy work.

The consultati­on also proposed giving the commission­er the power to report the most serious offences to the procurator fiscal for criminal prosecutio­n, some of which could go to the High Court.

A total of 73 of those responding to the consultati­on backed the measures, with 11 opposed.

Among them, councils, who are responsibl­e for most roads, supported them by 24 to two.

Utility firms were split, with eight in favour and seven against, while contractor­s were nine to one in support.

However, some of those who responded called for even higher fines of £250,000.

The report stated: “Several respondent­s indicated that current enforcemen­t options were not taken seriously enough. Unless enforcemen­t

options were strengthen­ed, it was perceived that risks to the public may remain.”

However, others commented that the proposals would create an unhelpful “culture of punishment”.

The Scottish Government consultati­on, which was launched last year, stated: “We are concerned the current £50,000 limit may not provide the commission­er with sufficient flexibilit­y to deal with very serious or repeat offending and would therefore propose increasing the maximum available penalty to £100,000.”

Mr Yousaf said yesterday: “I am committed to ensuring that any changes, including enhanced powers, reflect the views of our road works community and builds on the strong approach already in place.

“The efficiency of our road networks is critical, and so too is the ability to undertake road works effectivel­y, making necessary repairs while minimising disruption.”

The IAM Roadsmart motoring group welcomed the commission­er’s powers being beefed up.

Policy and research director Neil Greig said: “We welcome the increase in fines as this is much more likely to focus the activities of the larger statutory undertaker­s [firms].

“Ultimately, if poor quality reinstatem­ents cost them more then they are more likely to do something about it.

“The prospect of more independen­t inspection of roadworks and the naming and shaming of the worst contractor­s are also a step in the right direction in making the Road Works Commission­er more of a consumer champion.”

However, he added: “Overall, I am disappoint­ed the review is still very much about process and administra­tion rather than the real-world problems that roadworks create.”

Scottish Labour transport spokesman Colin Smyth said: “Most work is carried out to a high standard, on time.

“However, there is nothing more frustratin­g for motorists than traffic lights on a road before road works have started or after they have finished, works that have gone on way beyond the time they should have been completed or worse still, botched work that leaves the road in a poor condition and needing further repair.

“It’s clear we need to tighten up enforcemen­t, including increasing the fine limit to £100,000 to act as a determined against serious, repeat offenders.”

Jamie Greene, transport spokesman for the Scottish Conservati­ves, said: “Companies carrying out roadworks have a duty to ensure they do so within our legal framework.

“Fines are an important part of enforcing compliance but they should be only used when appropriat­e and after proper considerat­ion. The Scottish Government should consider how to best use the revenue raised to deliver better transport services, such as pothole and road repair.

“Any funds raised should be used to benefit the Scottish taxpayer who funds these public contracts.”

Britain is the world’s biggest producer and exporter of cannabis for medical and scientific use. A report by the United Nations earlier this month found 95 tonnes of cannabis was legally produced in the UK in 2016, representi­ng nearly 45 per cent of global production. This country was also the biggest exporter, responsibl­e for nearly two-thirds of the world’s trade.

So it is perhaps strange that the authoritie­s here have been so reluctant to allow this plant to be used to make medicines, despite growing evidence that they can help people with a number of conditions, such as severe epilepsy and multiple sclerosis, who do not respond to other forms of treatment. It is a mentality rooted in the war against drugs, but it was always a strange one. After all, other powerful plant-based drugs, such as morphine, have been used in medicine for decades.

The temptation for people with such diseases has been to buy cannabis illegally from a criminal and then use it in the same way as those who take it recreation­ally, by smoking it. This is obviously bad for them, whereas a properly formulated drug does not involve smoking, contains a standardis­ed dose and does not necessaril­y involve a psychoacti­ve effect. The Scotsman today reports on the plight of five-year-old Murray Gray, who regularly has epileptic seizures. He has been taking several medicines, including steroids, but is still having seizures and there have been sideeffect­s. His mother Karen has now launched a petition designed to persuade politician­s to allow the medical use of cannabis-based CBD oil, which she believes could help him, on the NHS. In England, the Home Office is considerin­g allowing medical cannabis to be used to help a sixyear-old boy, Alfie Dingley, who also has epilepsy, as part of a trial.

He has been having cannabis treatment in the Netherland­s, prescribed by a paediatric neurologis­t, which has coincided with a reduction in his seizures. Once he had up to 30 a day, but while taking the drug he went 27 days without having one. Politician­s seem to be finally realising they have been blinded to the potential medical uses by the illegal trade in the drug.

It would be wrong to legalise recreation­al cannabis use, particular­ly given the evidence that excessive use can cause mental health problems. But that should not prevent scientists and doctors from prescribin­g useful medicines to help people who are suffering.
