Chicken supreme?

Higher ed­u­ca­tion ex­perts have de­bated whether Har­vard Univer­sity should de­fend its af­fir­ma­tive ac­tion ad­mis­sions prac­tices all the way to the US Supreme Court. Any de­ci­sion in the trial over al­leged dis­crim­i­na­tion against Asian Amer­i­can ap­pli­cants is ex­pected to be chal­lenged in the na­tion’s high­est court, but some sec­tor ob­servers have sug­gested that the best op­tion may be for Har­vard to re­treat. They high­light that two re­cent ap­pointees to the Supreme Court, Brett Ka­vanaugh and Neil Gor­such, may swing the ma­jor­ity against af­fir­ma­tive ac­tion. One op­tion would be for Har­vard to de­vise other strate­gies to achieve the racial bal­ance it seeks and wait un­til the court bal­ance is more “amenable” be­fore push­ing for­ward.
