Man charged in fa­tal May wreck

Austin po­lice charged Daniel Gu­tier­rez-Franco, 20, on Thurs­day with man­slaugh­ter and in­tox­i­ca­tion man­slaugh­ter in a fa­tal wreck in South­east Austin in May.

Gu­tier­rez-Franco was drunk when he slammed a Ca­maro into a pole, killing his pas­sen­ger, ac­cord­ing to an ar­rest af­fi­davit. The crash oc­curred at East River­side Drive and the In­ter­state 35 north­bound frontage road. The af­fi­davit says a po­lice of­fi­cer saw the Ca­maro crash into the light pole about 2 a.m. May 24. Both Gu­tier­rez-Franco and his pas­sen­ger, Ra­mon Gu­tier­rez, were taken to Uni­ver­sity Med­i­cal Cen­ter Brack­en­ridge, where Gu­tier­rez later died, po­lice said.

The charges both carry a max­i­mum of 20 years in prison. Gu­tier­rez-Franco was in the Travis County Jail on Thurs­day with bail set at $100,000. Po­lice had ob­tained a search war­rant to con­duct a blood-al­co­hol test on him, and they said it showed he had a level of 0.25, more than three times the le­gal limit of 0.08.
