Man charged in fatal May wreck
Austin police charged Daniel Gutierrez-Franco, 20, on Thursday with manslaughter and intoxication manslaughter in a fatal wreck in Southeast Austin in May.
Gutierrez-Franco was drunk when he slammed a Camaro into a pole, killing his passenger, according to an arrest affidavit. The crash occurred at East Riverside Drive and the Interstate 35 northbound frontage road. The affidavit says a police officer saw the Camaro crash into the light pole about 2 a.m. May 24. Both Gutierrez-Franco and his passenger, Ramon Gutierrez, were taken to University Medical Center Brackenridge, where Gutierrez later died, police said.
The charges both carry a maximum of 20 years in prison. Gutierrez-Franco was in the Travis County Jail on Thursday with bail set at $100,000. Police had obtained a search warrant to conduct a blood-alcohol test on him, and they said it showed he had a level of 0.25, more than three times the legal limit of 0.08.
