Judge: In­mate should be freed

A judge who says a Hous­ton man spent 19 years in prison for a rape he didn’t com­mit has rec­om­mended his re­lease.

Mem­bers of 39-year-old Allen Wayne Porter’s fam­ily joy­fully jumped from their seats as state District Judge Joan Camp­bell made her rul­ing Thurs­day.

Porter’s at­tor­ney said her client was set to be re­leased on a re­cog­ni­zance bond Fri­day af­ter­noon while await­ing a fi­nal de­ci­sion by the Texas Court of Crim­i­nal Ap­peals. If the ap­peals court ac­cepts the judge’s rec­om­men­da­tion, it will or­der a new trial. But Bob Loper, the spe­cial pros­e­cu­tor, told the Hous­ton Chron­i­cle on Fri­day that he will move to dis­miss the case, so Porter will not be re­tried.
