man guilty in be­head­ing of kids

A jury has found a South Texas man guilty of cap­i­tal murder for be­head­ing his com­mon-law wife’s three chil­dren in 2003.

The Hi­dalgo County jury de­lib­er­ated for about three hours Mon­day be­fore re­turn­ing its ver­dict against John Allen Rubio in the sec­ond trial for the 29-year-old Brownsville man. A state ap­peals court had over­turned his pre­vi­ous con­vic­tion and death sen­tence in 2007.

Three be­headed chil­dren, all younger than 4 years, were found on March 11, 2003, in a squalid Brownsville apart­ment. The vic­tims were 3-year-old Julissa Que­sada, 14-month-old John E. Rubio and 2-month-old Mary Jane Rubio.

The trial now turns to the pun­ish­ment phase, in which pros­e­cu­tors will again
