Mur­der rap dropped in H-E-B drug killing

Prose­cu­tors now say man’s ac­com­plice was actual shooter in case.

Mur­der charges were dropped this week af­ter in­ves­ti­ga­tors took an­other look at a drug deal gone bad out­side of an H-E-B store last spring in South­east Austin.

John Paul Mon­toya, 20, was cleared in the May 20 shoot­ing of Jef­fry Rudy Sierra Lopez, pend­ing fur­ther in­ves­ti­ga­tion, court records show. He was re­leased from jail Wed­nes­day, but was sen­tenced that same day to six years of de­ferred ad­ju­di­ca­tion for two sep­a­rate and un­re­lated charges of bur­glary of a habi­ta­tion.
