Murder rap dropped in H-E-B drug killing
Prosecutors now say man’s accomplice was actual shooter in case.
Murder charges were dropped this week after investigators took another look at a drug deal gone bad outside of an H-E-B store last spring in Southeast Austin.
John Paul Montoya, 20, was cleared in the May 20 shooting of Jeffry Rudy Sierra Lopez, pending further investigation, court records show. He was released from jail Wednesday, but was sentenced that same day to six years of deferred adjudication for two separate and unrelated charges of burglary of a habitation.
