‘No con­test’ pleaded in child sex charges

A Tipp City man ac­cused of sex­ual con­duct with a mi­nor pleaded no con­test Thurs­day to felony sex­ual bat­tery and gross sex­ual im­po­si­tion as part of a plea deal in Mi­ami County Com­mon Pleas Court.

John Maingi, 38, ini­tially was in­dicted by a county grand jury on two felony counts of rape and two felony counts of gross im­po­si­tion.

The in­dict­ment al­leged the of­fenses oc­curred be­tween Au­gust 2011 and De­cem­ber 2016. One rape count stated the al­leged vic­tim was younger than 10. The sec­ond rape count stated the al­leged vic­tim was younger than 13.

Un­der the plea deal, out­lined in court by de­fense lawyer Kevin Len­nen, prose­cu­tors will rec­om­mend a three­year manda­tory prison term. Maingi could re­ceive up to 10 years in prison.

Judge Christo­pher Gee found him guilty, or­dered a pre-sen­tence in­ves­ti­ga­tion and sched­uled sen­tenc­ing for Dec. 10.

Gee also no­ti­fied Maingi he would be clas­si­fied at sen­tenc­ing as a Tier III sex of­fender.

The des­ig­na­tion will re­quire him, once re­leased from prison, to reg­is­ter his ad­dress with law en­force­ment where he lives ev­ery 90 days for the rest of his life.
