Mark Cuban gets ac­cess to records

A fed­eral judge said the Se­cu­ri­ties and Ex­change Com­mis­sion im­prop­erly with­held doc­u­ments from the Dal­las Mav­er­icks’ bil­lion­aire owner Mark Cuban, who is de­fend­ing him­self against charges of in­sider trad­ing.

The rul­ing by U.S. District Judge Reg­gie Wal­ton in Washington came a day af­ter a fed­eral ap­peals court re­in­stated the SEC’s civil fraud case against Cuban over his 2004 sale of stock in In­ter­net search com­pany Mamma.com.

Wal­ton said he could not con­clude the SEC made a “good faith ef­fort” to search for records that Cuban had re­quested un­der the Free­dom of In­for­ma­tion Act.
