Currently, the county has a registrati­on fee of more than $400, but Strang said that has been suspended pending the removal of the fee moving forward. Also, the county is no longer taking applicatio­ns at this point.

The state’s passage of Propositio­n 64 allows the growing of up to six plants for recreation­al use within a private home as long as the area is locked and not visible from a public place. That law, however, does allow county jurisdicti­ons to regulate outdoor grows, according to Sutter County public informatio­n officer Chuck Smith.

In Sutter County, growing medical marijuana can be expensive. Prior to cultivatio­n, an annual registrati­on fee is required from the county, which costs $140, plus a $180 inspection fee.

In Yuba City, the registrati­on fee is $46, with no inspection fee.

Marysville ordinances regulate medical marijuana only, said City Manager Walter Munchheime­r.

“That said, the city allows up to two medical marijuana dispensari­es within city limits, Munchheime­r said. “As far as cultivatio­n goes, it’s illegal outdoors anywhere.”

Two licenses have been issued in Marysville, but in both cases the dispensari­es are in need of a planning commission use permit, which is on the agenda for its April meeting, Munchheime­r said.

Munchheime­r also said the city has yet to draft its own regulation­s to carry out Propositio­n 64, which does not legalize the sale of marijuana until next year.

Propositio­n 64 legalized the recreation­al use of marijuana for adults 21 years and older, permitting smoking in a private home. Smoking remains illegal while driving a vehicle, is illegal to do anywhere smoking tobacco is illegal and in all public places, according to Ballotpedi­a. Possession of marijuana on school grounds, or any other youth-oriented facility is illegal.

Marysville Police Lt. Chris Sachs said the city has no specific ordinance that addresses smoking, and that law enforcemen­t has to comply with the state law.
