An effort is afoot in Washington to amend the Stark law to allow hospitals to quickly disclose and resolve “technical violations” of the
Medicare law against physician self-referral. The proposal would: • Allow healthcare providers to pay a $10,000 flat fee, instead of
per- claim penalties. • Only be open to “paperwork” violations, such as unsigned or lapsed
agreements for physician on- call coverage or medical office space. • Not apply to substantive violations, such as payments that exceed
market values or that drive up the number of patient referrals.
