An ef­fort is afoot in Wash­ing­ton to amend the Stark law to al­low hos­pi­tals to quickly dis­close and re­solve “tech­ni­cal vi­o­la­tions” of the

Medi­care law against physi­cian self-re­fer­ral. The pro­posal would: • Al­low health­care providers to pay a $10,000 flat fee, in­stead of

per- claim penal­ties. • Only be open to “pa­per­work” vi­o­la­tions, such as un­signed or lapsed

agree­ments for physi­cian on- call cov­er­age or med­i­cal of­fice space. • Not ap­ply to sub­stan­tive vi­o­la­tions, such as pay­ments that ex­ceed

mar­ket val­ues or that drive up the num­ber of pa­tient re­fer­rals.
