NLRB rul­ing on staffing agen­cies won’t stand up to scru­tiny

Re­gard­ing the Aug. 28 online ar­ti­cle “NLRB rul­ing could shake up healthcare staffing in­dus­try,” the rul­ing won’t stand be­cause it has no ba­sis in law or com­mon sense. Un­der this rul­ing, your garbage col­lec­tor is your em­ployee be­cause you im­pact his/her job by putting out the trash on Wed­nes­days (thereby dic­tat­ing his/her work sched­ule), and agree­ing to the garbage col­lec­tion fee—which (in their id­i­otic the­ory) means you ma­te­ri­ally im­pact the worker’s wages. This “knee bone is con­nected to the thigh bone” ap­proach will end up in the trash bin of history.
