NYC hospi­tal faces suit over charges for med­i­cal records

New York Pres­by­te­rian/Columbia Univer­sity Med­i­cal Cen­ter charged a 71-year-old pa­tient $2,694 for the re­lease of her elec­tronic health records, ac­cord­ing to her lawyer. The charges were based on a pay­ment rate of $1.50 a page, the suit al­leges.

That’s dou­ble the $0.75 per page rate limit set by New York and a vi­o­la­tion of state law, at­tor­ney Low­ell Sid­ney said. Sid­ney has filed a class-ac­tion suit against the hospi­tal and IOD Inc., of Green Bay, Wis., a doc­u­ment man­age­ment ven­dor that pro­vided re­lease of in­for­ma­tion ser­vices for the hospi­tal.

The suit con­tends through the plain­tiffs’ “wrong­ful and un­law­ful con­duct” they’ve re­ceived “sub­stan­tial prof­its and wind­falls” and have been “un­justly en­riched at the ex­pense of plain­tiff and mem­bers of her class.” The suit seeks un­spec­i­fied dam­ages.
