Lawsuit says kin set up by bad cop

THE EX-WIFE of a wrongly convicted Brooklyn man and their two children are suing a controvers­ial cop who they say railroaded the man decades ago.

Derrick Hamilton’s exwife, and their son and daughter, argue in a lawsuit filed Thursday that they had a right to be together as a family — but ex-detective Louis Scarcella and other law enforcemen­t agents smashed up the family.

Hamilton’s 1991 murder conviction was cleared in 2015 after Brooklyn prosecutor­s said they couldn’t stand by the case. Hamilton, a 52-year-old father of five, has maintained his innocence and said Scarcella framed him. Scarcella has said he’s done wrong in any cases.

Hamilton’s 2015 federal civil rights suit against New York City, Scarcella and others is pending. Court papers last month said the parties “are in active discussion toward a settlement of this matter.”

Now, his ex-wife Richetta Greene and kids Davone Greene, 34, and Brittany Hamilton, 26, are suing too. They said the alleged misconduct leading to Hamilton’s conviction and lockup all resulted in “severe familial discord and the loss of services of a father and husband.”

“I think that Scarcella should be liable,” Hamilton told the Daily News. “He should be liable, just like I’d be liable.” nothing
