W. Ha­zle­ton man waives child porn pre­lim­i­nar y hear­ing

A West Ha­zle­ton man on pro­ba­tion af­ter plead­ing guilty to child pornog­ra­phy charges waived his right to a pre­lim­i­nary hear­ing on new child pornog­ra­phy charges be­fore Mag­is­te­rial District Judge James M. Dixon.

Michael An­thony Por­tanova, 26, of 325 Ridge Ave., is fac­ing felony counts of pos­sess­ing child porn and crim­i­nal use of a com­mu­ni­ca­tion fa­cil­ity af­ter police say they found 63 videos on a mem­ory card from his cell­phone, in­clud­ing nu­mer­ous videos of chil­dren per­form­ing sex acts.

Ac­cord­ing to an af­fi­davit filed by Luzerne County De­tec­tive Charles Balogh, pro­ba­tion of­fi­cers con­tacted in­ves­ti­ga­tors in Oc­to­ber to re­port Por­tanova had failed a lie-de­tec­tor test when asked if he was look­ing at child porn.

Por­tanova ad­mit­ted to state police he started us­ing his cell­phone to down­load and view child pornog­ra­phy again be­cause he was stressed, the af­fi­davit states.
