Cohoes man gets 50 years in rape case

ALBANY, N.Y. >> Albany County District Attorney P. David Soares announced the sentencing of Derrick Rosa, 39, of Cohoes, to 25 years in state prison for one count of firstdegre­e criminal sexual act and a consecutiv­e sentence of 25 years in state prison for one count of first- degree rape.

The 50-year sentence is to be fol lowed by 25 years of post- r elease super v i sion. Additional ly, Rosa will have to register as a sex offender upon release.

On Jan. 11, Rosa was found guilty after a jury trial of one count of first- degree felony criminal sexual act, one count of second- degree felony criminal sexual act, two counts of first- degree felony rape, one count of second- degree felony rape, one count of third-degree felony rape and two counts of misdemeano­r endangerin­g the welfare of a child.

After deliberati­on and review of the presented evidence during the trial, the jury found that on an evening between Oct. 9, 2014 and Oct. 31, 2014, Rosa engaged in forcible oral sexual conduct with a child who was 14 years old at the time.

Between Nov. 27, 2014 and Dec. 25, 2014, he engaged in forcible sexual intercours­e with the same child. This conduct continued with the child until the final act of sexual intercours­e occurred on Aug. 22, 2017, again by forcible compulsion, when she was now 16 years old. Over the aforementi­oned period of time, Rosa engaged in multiple acts of physical abuse against the child as well.

In addition, Rosa did knowingly act in a manner likely to be harmful to the physical, mental, or moral welfare of an additional child in the home during the same time period.
