Po­lice cite man in fa­tal ac­ci­dent

Mont­gomery County District At­tor­ney Risa Vetri Fer­man and Hat­boro Po­lice Chief James E. Gard­ner an­nounce the re­sults of the in­ves­ti­ga­tion into the pedes­trian fa­tal­ity that oc­curred on North Warmin­ster Road in Hat­boro this past Novem­ber.

Af­ter an in­ves­ti­ga­tion it was de­ter­mined that on Nov.16 at ap­prox­i­mately 6:16 p.m., a 2002 Dodge Du­rango, op­er­ated by Ben­jamin Ir­ven Be­liv­eau, 60, of the 200 block of North Warmin­ster Road, Up­per Moreland Town­ship, struck and killed Dorothy A. Lodge, 75, of the 400 block of Ash­ley Av­enue, Up­per Moreland.

The joint in­ves­ti­ga­tion of the in­ci­dent, con­ducted by the Hat­boro Po­lice De­part­ment and Mont­gomery County de­tec­tives, showed that Be­liv­eau was driv­ing his ve­hi­cle south­bound on North Warmin­ster Road, near Ly­coming Av­enue, over the speed limit when the vehi- cle struck and killed Lodge who was in the process of cross­ing Warmin­ster Road.

Within min­utes of the ac­ci­dent Be­liv­eau called 911 from his home and re­ported he may have struck some­thing on Warmin­ster Road. Be­liv­eau re­ported that he was un­sure what he had struck and drove around the block ul­ti­mately go­ing to his home lo­cated near the scene of the col­li­sion.

The cir­cum­stances of the in­ci­dent were re­viewed by pros­e­cu­tors and de­tec­tives from the Mont­gomery County District At­tor­ney’s Of­fice, and based on that re­view the case was re­ferred back to the Hat­boro Po­lice De­part­ment for sum­mary pros­e­cu­tion. As a re­sult, Be­liv­eau was is­sued ci­ta­tions for care­less driv­ing re­sult­ing in an un­in­ten­tional death, max­i­mum speed lim­its, and driv­ing ve­hi­cle at a safe speed, po­lice said.
