Bill Pro­pos­als Num­ber Hun­dreds

The ple­nary ses­sion of the Leg­isla­tive Cham­ber of Oliy Ma­jlis, which was held on Novem­ber 28, be­gan with a second read­ing of the draft law «On Amend­ments and Ad­denda to the Law of the Repub­lic of Uzbek­istan “On the For­est””.

The par­lia­men­tar­i­ans noted that dur­ing prepa­ra­tion of the draft law for con­sid­er­a­tion in the lower house of par­lia­ment, for wide dis­cus­sion, he was sent to rel­e­vant min­istries and de­part­ments, NGOs to re­ceive pro­pos­als and rec­om­men­da­tions. In ad­di­tion, the pro­ject was posted on the web­sites of the lower house of par­lia­ment and the Eco-move­ment, as well as in the so­cial net­work for pub­lic dis­cus­sion. As a re­sult, there are more than 250 pro­pos­als and rec­om­men­da­tions, many of which were taken into account when fi­nal­iz­ing the doc­u­ment in prepa­ra­tion for the second read­ing.

Peo­ple's deputies stressed that the adop­tion of this law con­trib­utes to the ra­tional and care­ful use of for­est re­sources, as well as the ef­fec­tive man­age­ment of the for­est fund and pro­tected nat­u­ral ar­eas, the cre­ation, re­pro­duc­tion, pro­tec­tion and pro­tec­tion of planted forests.

Deputies also con­sid­ered in the first read­ing the draft law “On Amend­ments and Ad­denda to the Law of the Repub­lic of Uzbek­istan on State Awards”. It de­fines the con­cept of state award, es­tab­lishes that they are es­tab­lished by the laws of the coun­try, and that cit­i­zens of the repub­lic can also be awarded with for­eign state awards.

There are types of state awards and hon­orary ti­tles. The le­gal sta­tus of the Com­mis­sion on State Awards and Her­aldry un­der the Pres­i­dent of Uzbek­istan is se­cured with the as­sign­ment to it of the func­tions to en­sure the im­plemen­tation of the con­sti­tu­tional pow­ers of the head of state as­so­ci­ated with the de­ci­sion of is­sues of award­ing state awards.

In ad­di­tion, the regulation of the es­tab­lish­ment of state awards, com­mem­o­ra­tive and breast­plates, de­part­men­tal awards, which are not state awards, are reg­u­lated.

In the first read­ing, the draft law “On Amend­ments and Ad­di­tions to Cer­tain Leg­isla­tive Acts of the Repub­lic of Uzbek­istan in Con­nec­tion with the Im­prove­ment of Par­lia­men­tary Con­trol” was con­sid­ered.

Peo­ple’s deputies noted that an ef­fec­tive tool to strengthen the role and place of par­lia­ment in en­sur­ing ef­fec­tive im­plemen­tation of leg­is­la­tion, re­spect for the rights, free­doms and le­git­i­mate in­ter­ests of cit­i­zens is the ex­ten­sion of par­lia­men­tary con­trol not only to state bod­ies, but also to eco­nomic man­age­ment bod­ies.

It is es­pe­cially em­pha­sized that the in­tro­duc­tion of the «gov­ern­ment hour» in­sti­tute into the na­tional leg­is­la­tion in the Leg­isla­tive Cham­ber, based on the ex­pe­ri­ence of de­vel­oped coun­tries, will al­low im­prov­ing the in­ter­ac­tion be­tween the leg­isla­tive and ex­ec­u­tive branches in terms of ex­er­cis­ing par­lia­men­tary con­trol, as well as pro­vid­ing ad­di­tional mech­a­nisms to en­hance the re­spon­si­bil­ity of the mem­bers of the gov­ern­ment to the par­lia­ment. It is also re­quired at the leg­isla­tive level to con­sol­i­date hear­ings at meet­ings of the Se­nate of the Oliy Ma­jlis of re­ports of hokims on the devel­op­ment of the re­spec­tive ter­ri­to­ries.

Also con­sid­ered in the first read­ing was the draft law “On Amend­ments and Ad­di­tions to the Law of the Repub­lic of Uzbek­istan» On plant quar­an­tine”. In its devel­op­ment, leg­is­la­tion in the field of plant quar­an­tine has been stud­ied in Rus­sia, the United States, China, Ukraine, Be­larus and the coun­tries of the Euro­pean Union. Based on for­eign ex­pe­ri­ence, the quar­an­tine re­quire­ments and norms that im­port­ing and ex­port­ing busi­ness en­ti­ties should com­ply with are re­vised, the tasks of state in­spec­tors for plant quar­an­tine are spec­i­fied, the procedure for mon­i­tor­ing in the field of plant quar­an­tine is spec­i­fied.

Adop­tion of this le­gal act will al­low to im­prove the mech­a­nism of regulation of the re­la­tions in the field of a quar­an­tine of plants, to ex­pand the in­ter­na­tional co­op­er­a­tion, to in­tro­duce mod­ern for­eign tech­nolo­gies and meth­ods of work in ac­tiv­ity of the rel­e­vant ser­vices.

Also, in the first read­ing, the draft law “On Amend­ments and Ad­denda to Cer­tain Leg­isla­tive Acts of the Repub­lic of Uzbek­istan” was dis­cussed. It is aimed at im­prov­ing the mech­a­nism for iden­ti­fy­ing con­certed ac­tions and agree­ments re­strict­ing com­pe­ti­tion, sim­pli­fy­ing the procedure for agree­ing on the ac­qui­si­tion of shares by busi­ness en­ti­ties with the an­ti­monopoly author­ity, ex­clud­ing a pos­si­ble con­flict of in­ter­ests by pro­hibit­ing the par­tic­i­pa­tion of sub­sidiaries and de­pen­dent busi­ness en­ti­ties, and uni­tary en­ter­prises in the au­tho­rized cap­i­tal of the par­ent com­pany. In ad­di­tion, it is aimed at im­prov­ing leg­is­la­tion in the field of com­pe­ti­tion and cor­po­rate gov­er­nance.

The draft law was posted for dis­cus­sion at the sin­gle por­tal for in­ter­ac­tive state ser­vices. Dur­ing the dis­cus­sion, a num­ber of pro­pos­als were re­ceived from cit­i­zens and busi­ness en­ti­ties, in par­tic­u­lar, the in­clu­sion of a ban on the own­er­ship of a uni­tary en­ter­prise by shares in the statu­tory fund of its owner, as well as the mem­ber­ship of the head and em­ploy­ees of a uni­tary en­ter­prise in the su­per­vi­sory board of the main eco­nomic com­pany.

Mem­bers of the fac­tions noted that the adop­tion of this law will con­trib­ute to rais­ing Uzbek­istan's rat­ing in the World Bank’s “Do­ing Busi­ness” in­dex, as well as sim­pli­fy­ing the ex­ist­ing ones and re­duc­ing un­nec­es­sary li­cens­ing pro­ce­dures.

At the meet­ing, other draft laws were also con­sid­ered and adopted in the first read­ing.
