The plenary session of the Legislative Chamber of Oliy Majlis, which was held on November 28, began with a second reading of the draft law «On Amendments and Addenda to the Law of the Republic of Uzbekistan “On the Forest””.
The parliamentarians noted that during preparation of the draft law for consideration in the lower house of parliament, for wide discussion, he was sent to relevant ministries and departments, NGOs to receive proposals and recommendations. In addition, the project was posted on the websites of the lower house of parliament and the Eco-movement, as well as in the social network for public discussion. As a result, there are more than 250 proposals and recommendations, many of which were taken into account when finalizing the document in preparation for the second reading.
People's deputies stressed that the adoption of this law contributes to the rational and careful use of forest resources, as well as the effective management of the forest fund and protected natural areas, the creation, reproduction, protection and protection of planted forests.
Deputies also considered in the first reading the draft law “On Amendments and Addenda to the Law of the Republic of Uzbekistan on State Awards”. It defines the concept of state award, establishes that they are established by the laws of the country, and that citizens of the republic can also be awarded with foreign state awards.
There are types of state awards and honorary titles. The legal status of the Commission on State Awards and Heraldry under the President of Uzbekistan is secured with the assignment to it of the functions to ensure the implementation of the constitutional powers of the head of state associated with the decision of issues of awarding state awards.
In addition, the regulation of the establishment of state awards, commemorative and breastplates, departmental awards, which are not state awards, are regulated.
In the first reading, the draft law “On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan in Connection with the Improvement of Parliamentary Control” was considered.
People’s deputies noted that an effective tool to strengthen the role and place of parliament in ensuring effective implementation of legislation, respect for the rights, freedoms and legitimate interests of citizens is the extension of parliamentary control not only to state bodies, but also to economic management bodies.
It is especially emphasized that the introduction of the «government hour» institute into the national legislation in the Legislative Chamber, based on the experience of developed countries, will allow improving the interaction between the legislative and executive branches in terms of exercising parliamentary control, as well as providing additional mechanisms to enhance the responsibility of the members of the government to the parliament. It is also required at the legislative level to consolidate hearings at meetings of the Senate of the Oliy Majlis of reports of hokims on the development of the respective territories.
Also considered in the first reading was the draft law “On Amendments and Additions to the Law of the Republic of Uzbekistan» On plant quarantine”. In its development, legislation in the field of plant quarantine has been studied in Russia, the United States, China, Ukraine, Belarus and the countries of the European Union. Based on foreign experience, the quarantine requirements and norms that importing and exporting business entities should comply with are revised, the tasks of state inspectors for plant quarantine are specified, the procedure for monitoring in the field of plant quarantine is specified.
Adoption of this legal act will allow to improve the mechanism of regulation of the relations in the field of a quarantine of plants, to expand the international cooperation, to introduce modern foreign technologies and methods of work in activity of the relevant services.
Also, in the first reading, the draft law “On Amendments and Addenda to Certain Legislative Acts of the Republic of Uzbekistan” was discussed. It is aimed at improving the mechanism for identifying concerted actions and agreements restricting competition, simplifying the procedure for agreeing on the acquisition of shares by business entities with the antimonopoly authority, excluding a possible conflict of interests by prohibiting the participation of subsidiaries and dependent business entities, and unitary enterprises in the authorized capital of the parent company. In addition, it is aimed at improving legislation in the field of competition and corporate governance.
The draft law was posted for discussion at the single portal for interactive state services. During the discussion, a number of proposals were received from citizens and business entities, in particular, the inclusion of a ban on the ownership of a unitary enterprise by shares in the statutory fund of its owner, as well as the membership of the head and employees of a unitary enterprise in the supervisory board of the main economic company.
Members of the factions noted that the adoption of this law will contribute to raising Uzbekistan's rating in the World Bank’s “Doing Business” index, as well as simplifying the existing ones and reducing unnecessary licensing procedures.
At the meeting, other draft laws were also considered and adopted in the first reading.
