Bill Trig­gers Dis­putes

In Uzbek­istan, one of the most im­por­tant di­rec­tions of state pol­icy is the pro­tec­tion of the rights and in­ter­ests of women. Ev­ery year women’s ac­tiv­ity in the pub­lic, po­lit­i­cal, eco­nomic and so­cial life of the coun­try in­creases.

Women work and self-real­ize in var­i­ous spheres and in­dus­tries, make a wor­thy con­tri­bu­tion to the de­vel­op­ment and pros­per­ity of our Mother­land. In this re­gard, the pro­tec­tion of the rights and le­git­i­mate in­ter­ests of women, the strength­en­ing and im­prove­ment of the spir­i­tual and moral en­vi­ron­ment in fam­i­lies are con­sid­ered the most im­por­tant is­sues of the day.

Re­cently, the Com­mis­sion on Fam­ily and Women’s Is­sues dis­cussed the draft law with the Com­mit­tee on In­dus­try, Con­struc­tion and Trade of the lower house of par­lia­ment “On Amend­ments to Ar­ti­cle 32 of the Hous­ing Code of the Repub­lic of Uzbek­istan”.

It was at­tended by deputies of the Leg­isla­tive Cham­ber of the Oliy Ma­jlis, mem­bers of the Com­mis­sion on Fam­ily and Women, as well as a work­ing group, ex­perts, em­ploy­ees of min­istries and de­part­ments, the me­dia.

It should be noted that the bill in­tro­duced by the Cabi­net of Min­is­ters on Septem­ber 18 this year was con­cep­tu­ally dis­cussed in the Leg­isla­tive Cham­ber of Par­lia­ment.

The draft law was de­vel­oped by the Min­istry of Jus­tice in ac­cor­dance with the Pro­gram of Com­pre­hen­sive Mea­sures to Sup­port Women and Strengthen the Fam­ily In­sti­tute, ap­proved by Pres­i­den­tial De­cree of Fe­bru­ary 2, 2018.

The main ob­jec­tive of the doc­u­ment is to strengthen and im­prove the spir­i­tual and moral en­vi­ron­ment in fam­i­lies, pre­vent and pre­vent di­vorce and the prob­lems that arise, cre­ate ef­fec­tive mech­a­nisms for the full le­gal sup­port of women and chil­dren.

The bill pro­poses to rec­og­nize the spouses of the chil­dren of the owner, hav­ing their own fam­i­lies and per­ma­nently liv­ing with him, as mem­bers of the fam­ily of the given owner, if they have not pre­vi­ously ac­quired this right. As a re­sult, on the ba­sis of the first part of Ar­ti­cle 32 of the Hous­ing Code, the spouses of the chil­dren of the owner, who have their own fam­i­lies, ac­quire the right to use the premises in the house or apart­ment, along with other mem­bers of the fam­ily of the owner of the apart­ment house or apart­ment.

These changes will help pre­vent fam­ily di­vorces and women’s right to use the house, the owner’s apart­ment and the in­tro­duc­tion of their chil­dren in a real house, apart­ment in case of di­vorce.

The bill has caused a lot of con­tro­versy at meet­ings of fac­tions of po­lit­i­cal par­ties and deputies from the Eco­log­i­cal Move­ment.

In this re­gard, at the event, the opin­ions and pro­pos­als of deputies, ex­perts, sci­en­tists and mem­bers of the pub­lic re­gard­ing this topic were stud­ied in de­tail.

At an event held in a con­struc­tive spirit, the par­tic­i­pants re­viewed each rule of the draft law and noted the need to im­prove its le­gal mech­a­nism.

Tak­ing into ac­count the pro­posed opin­ions and rec­om­men­da­tions, an ap­pro­pri­ate de­ci­sion was taken.
