Com­mu­nity ser­vice for at­tempted mur­der

TWO men from Mag­wegwe sub­urb in Bu­l­awayo who stabbed their friend and left his in­testines hang­ing after he re­fused to buy them beer, were yes­ter­day lucky to es­cape with com­mu­nity ser­vice sen­tences.

Lucky Men­ziwa (19) and Prichard Moyo (23) be­came an­gry when Mr Kwanele Ncube scolded them for drink­ing his beer with­out in­vi­ta­tion.They were not buy­ing any beer.

A court heard how the duo ac­cused Mr Ncube of be­ing con­ceited after he aban­doned them at Mazai­wana Bot­tle Store in Mag­wegwe North sub­urb, leav­ing them with­out any­one to buy them beer.

Mr Ncube later met the pair in his neigh­bour­hood and they at­tacked him.

Prose­cut­ing, Mr Ti­nashe Dzipe told the court that the duo stabbed Mr Ncube.

“The two ac­cused per­sons as­saulted com­plainant with fists and kicked him all over the body. As com­plainant tried to flee the scene, he was stabbed. He then re­alised that his in­testines were pro­trud­ing. He fell un­con­scious and passersby called an am­bu­lance that fer­ried him to Mpilo (Cen­tral Hos­pi­tal) where he was ad­mit­ted,” said Mr Dzipe.

Men­ziwa and Moyo pleaded not guilty to an at­tempted mur­der charge but Bu­l­awayo re­gional mag­is­trate Mr Joseph Mabeza con­victed the two and gave them a com­mu­nity ser­vice sen­tence.

“Men­ziwa you are only 19-years-old and such a life style is not ap­pro­pri­ate for you. You still have a lot to learn about life. Moyo at age 23 you are a fam­ily man al­ready and in­car­cer­at­ing you will be a pun­ish­ment for those who are in your cus­tody. The at­tack on Ncube was sense­less. You should learn to re­spect life,” said Mr Mabeza.

He sen­tenced Moyo to 30 months in jail and sus­pended 15 months for the next five years on con­di­tion of good be­hav­iour. “The other 15 months are sus­pended on con­di­tion you per­form 525 hours of com­mu­nity ser­vice,” said Mr Mabeza.

The mag­is­trate sen­tenced Men­ziwa to three years in jail.

He sus­pended one and a half years for five years and com­muted the re­main­ing one and a half years to 620 hours of com­mu­nity ser­vice. The duo cel­e­brated when the sen­tence was read out. — @tan­nytkay
