Community service for attempted murder
TWO men from Magwegwe suburb in Bulawayo who stabbed their friend and left his intestines hanging after he refused to buy them beer, were yesterday lucky to escape with community service sentences.
Lucky Menziwa (19) and Prichard Moyo (23) became angry when Mr Kwanele Ncube scolded them for drinking his beer without invitation.They were not buying any beer.
A court heard how the duo accused Mr Ncube of being conceited after he abandoned them at Mazaiwana Bottle Store in Magwegwe North suburb, leaving them without anyone to buy them beer.
Mr Ncube later met the pair in his neighbourhood and they attacked him.
Prosecuting, Mr Tinashe Dzipe told the court that the duo stabbed Mr Ncube.
“The two accused persons assaulted complainant with fists and kicked him all over the body. As complainant tried to flee the scene, he was stabbed. He then realised that his intestines were protruding. He fell unconscious and passersby called an ambulance that ferried him to Mpilo (Central Hospital) where he was admitted,” said Mr Dzipe.
Menziwa and Moyo pleaded not guilty to an attempted murder charge but Bulawayo regional magistrate Mr Joseph Mabeza convicted the two and gave them a community service sentence.
“Menziwa you are only 19-years-old and such a life style is not appropriate for you. You still have a lot to learn about life. Moyo at age 23 you are a family man already and incarcerating you will be a punishment for those who are in your custody. The attack on Ncube was senseless. You should learn to respect life,” said Mr Mabeza.
He sentenced Moyo to 30 months in jail and suspended 15 months for the next five years on condition of good behaviour. “The other 15 months are suspended on condition you perform 525 hours of community service,” said Mr Mabeza.
The magistrate sentenced Menziwa to three years in jail.
He suspended one and a half years for five years and commuted the remaining one and a half years to 620 hours of community service. The duo celebrated when the sentence was read out. — @tannytkay
