Driver re­verses over ten­ant’s son

A MAN from En­tum­bane sub­urb in Bu­l­awayo has been ar­raigned to court af­ter he fa­tally ran over his ten­ant’s five-year-old son while re­vers­ing his ve­hi­cle in the yard.

Du­miso Ncube (44) pleaded guilty to a charge of cul­pa­ble homi­cide when he ap­peared be­fore Western Com­mon­age Mag­is­trate Mr Stephen Ndhlovu and was granted $100 bail to Mon­day for sen­tenc­ing.

For the State, Ms Mar­gret Takawira said on Septem­ber 7 at 7PM, Ncube was re­vers­ing a Toy­ota Gaia into the yard when he hit the de­ceased Du­moluhle Moyo.

“On Septem­ber 7, 2016, at around 7PM, the ac­cused per­son was driv­ing a Toy­ota Gaia reg­is­tra­tion num­ber ACR1587, re­vers­ing into the yard. The de­ceased, who is the son of a ten­ant re­sid­ing at Ncube’s house, came run­ning into the yard and did not see the re­vers­ing ve­hi­cle,” said Ms Takawira.

Du­moluhle sus­tained head in­juries and was rushed to Mpilo Cen­tral Hos­pi­tal where he was pro­nounced dead on ad­mis­sion.

A post-mortem es­tab­lished that the five-year-old died from in­ter­nal in­juries.

Ms Takawira told the court that the ac­ci­dent oc­curred dur­ing the night when vis­i­bil­ity was poor.

The ve­hi­cle was re­ferred to the Ve­hi­cle Inspection Depart­ment for inspection and the VID re­port was pro­duced in court as an ex­hibit. The re­port said the ve­hi­cle was road­wor­thy. Ncube is a holder of a valid driver’s li­cence.

“It is the State’s case that the ac­cused per­son was neg­li­gent as he failed to keep a look­out in the cir­cum­stances and failed to keep the ve­hi­cle un­der proper con­trol,” said Ms Takawira. — @andile_t­shuma
