“The mulch is be­ing used as part of the reveg­e­ta­tion and land­scap­ing process,” the Main Roads spokesman said. A De­part­ment of En­vi­ron­men­tal Regulation spokesman said the DER was no­ti­fied of the dis­cov­ery of as­bestos on Novem­ber 9.

Two days later, the DER is­sued an En­vi­ron­men­tal Field Re­port to the Purearth com­post­ing fa­cil­ity to cease the dis­tri­bu­tion of the mulch, and this was fol­lowed up with a Pre­ven­tion No­tice on Novem­ber 15.

In­ves­ti­ga­tions into the cause of the con­tam­i­na­tion are on­go­ing.

A pre­ven­tion no­tice can be used by the DER to im­pose con­di­tions on a per­son or re­quire them to take ac­tions to pre­vent, abate or deal with pol­lu­tion and fi­nan­cial penal­ties ap­ply
