“The mulch is being used as part of the revegetation and landscaping process,” the Main Roads spokesman said. A Department of Environmental Regulation spokesman said the DER was notified of the discovery of asbestos on November 9.
Two days later, the DER issued an Environmental Field Report to the Purearth composting facility to cease the distribution of the mulch, and this was followed up with a Prevention Notice on November 15.
Investigations into the cause of the contamination are ongoing.
A prevention notice can be used by the DER to impose conditions on a person or require them to take actions to prevent, abate or deal with pollution and financial penalties apply
