Road ragers set to face their sen­tence

The pas­sen­ger who hung out of a car and smashed an­other car’s win­dow with a base­ball bat dur­ing a ter­ri­fy­ing road rage at­tack on For­rest High­way will be sen­tenced along­side his driver.

Kale John Cal­le­gari, 20, of Aus­tralind, was a pas­sen­ger in Sa­muel Josef King’s car, in which the pair went on a dis­turb­ing road rage at­tack on Septem­ber 30 when the in­ci­dent was live-streamed on so­cial me­dia.

Cal­le­gari ap­peared in Bun­bury Mag­is­trates Court on Thurs­day when he pleaded guilty to a string of charges over the in­ci­dent.

King, the 21-year-old driver from Leschenault, ad­mit­ted to the in­ci­dent a week ear­lier when he was told a term of im­pris­on­ment was “cer­tainly on the ta­ble”.

King was driv­ing a Holden util­ity on Old Coast Road in Aus­tralind when he re­tal­i­ated to an al­leged al­ter­ca­tion with an­other driver by ac­cel­er­at­ing heav­ily, reach­ing ex­ces­sive speeds and at times cross­ing to the wrong side of the road into on­com­ing traf­fic.

King handed Cal­le­gari a “child-size” base­ball bat – which he kept in the car to play fetch with his dog – and told him to “smash him with that” while film­ing the in­ci­dent on a mo­bile phone.

The road rage at­tack con­tin­ued onto For­rest High­way where Cal­le­gari hung out of the mov­ing car and smashed the win­dow.

In court on Thurs­day, de­fence lawyer Jeanette de Klerk asked for Cal­le­gari’s sen­tenc­ing to be ad­journed so that pre-sen­tence and psy­cho­log­i­cal re­ports could be pre­pared.

Po­lice pros­e­cu­tor Sgt Greg Ward asked for sen­tenc­ing to be on the same day as King to al­low for par­ity.

Mag­is­trate Brian Ma­hon agreed that par­ity was ap­pro­pri­ate and told Cal­le­gari to “keep your best foot for­ward” un­til sen­tenc­ing in Jan­uary.

The same re­ports have been or­dered for King.

Cal­le­gari re­fused to comment out­side of court but a fam­ily mem­ber told me­dia he was not dis­ap­pointed in Cal­le­gari and the me­dia was “balls­ing the whole thing up”.
