Man jailed for ‘terrible’ glass attack

A KING Island man who threw a 10 ounce beer glass at a bar attendant’s face has been jailed over the “serious attack”.

Stuart Russell Day, 28, was sentenced in the Supreme Court in Burnie yesterday after pleading guilty to a charge of wounding.

The court heard Day assaulted the woman, who he had a longstandi­ng problem with, while she was working at a bar in Currie on November 26 last year.

Chief Justice Alan Blow said Day was lucky he didn’t damage the woman’s eye in the assault.

“You lost your temper and you threw a 10 ounce beer glass towards her face,” he said.

“It cut her left eyebrow open and she began to bleed profusely from the eyebrow. It was a terrible thing to do. You were in a public place.

“You not only assaulted this woman, but you used the glass as a weapon. It is lucky for you and for her that you did not do more harm than you did.”

Chief Justice Blow said the victim ended up with a permanent scar about two inches long through her eyebrow and continued to suffer with a number of psychologi­cal symptoms as a result of the incident.

“She left that job, had some time off work, and ultimately found another job as a result of your attack on her in her workplace,” he said.

“I think it is fair to say that, quite apart from the scar, she still has not got over what you did to her.”

The court heard Day suffered from episodes of depression and had resorted to drug use.

The court was also told he had a criminal record, mostly for dishonesty and drug offences, but none of his prior conviction­s had anything to do with violence.

Chief Justice Blow acknowledg­ed Day would lose his secure employment if he was sent to jail, but said imprisonme­nt was appropriat­e given the seriousnes­s of the attack.

He was sentenced to 10 months in jail, with five months of the sentence suspended on the condition that he not commit another offence punishable by imprisonme­nt for 18 months after his release.

Chief Justice Blow also ordered that Day be subject to a probation order, which will include undergoing assessment and treatment for alcohol and drug dependency. chanel.kinniburgh@
