Coun­cil over­rid­den for homes project

The De­part­ment of Plan­ning’s abil­ity to over­ride de­ci­sions made by lo­cal gov­ern­ments was on show ear­lier this month as a hous­ing de­vel­op­ment in Ore­lia was granted sign-off, de­spite the City of Kwinana coun­cil re­ject­ing the pro­posal.

Ap­pli­cant Tay­lor Bur­rell Barnett sub­mit­ted a de­vel­op­ment ap­pli­ca­tion to the City to build 47 mul­ti­ple dwellings and 52 group dwellings on Berthold Street, which was dis­cussed at the Oc­to­ber 25 Kwinana coun­cil meet­ing.

A de­bate be­tween coun­cil­lors fol­lowed, with Cr Den­nis Wood ex­press­ing his con­cern the tight-knit na­ture of the hous­ing de­vel­op­ment could im­pede ser­vice ve­hi­cles from ac­cess­ing homes.

Cr Peter Feasey went one step fur­ther, stat­ing the de­vel­oper was “try­ing to make a quick buck” and that Kwinana de­served bet­ter.

The coun­cil voted 7-1 re­ject­ing the pro­posal.

How­ever, be­cause the value of the de­vel­op­ment is more than $10 mil­lion, the fi­nal de­ci­sion lay with the Metropoli­tan South-West Joint De­vel­op­ment As­sess­ment Panel.

The five-per­son panel met on Novem­ber 8 and in­cluded Cr Wood and Cr Sheila Mills rep­re­sent­ing the City of Kwinana, and three DAP mem­bers.

Cr Wood moved a mo­tion to de­fer the ap­pli­ca­tion for three months, but this was re­jected, with the panel vot­ing 4-1 in favour of ap­prov­ing the ap­pli­ca­tion. Kwinana Mayor Carol Adams said the City would need to work with the de­vel­oper as the pro­posal be­comes a reality.

“A big ob­jec­tive for the City, in re­spect to land use plan­ning, is and will al­ways be to en­cour­age thought­fully de­signed devel­op­ments which com­ple­ment their sur­round­ings,” she said.

“While the City is dis­ap­pointed that the ap­pli­ca­tion did not, in our view, meet this ex­pec­ta­tion, we ac­cept the JDAP de­ci­sion and will work con­struc­tively with the de­vel­oper to achieve the best pos­si­ble out­come for the Kwinana com­mu­nity.”
