Fine for graffiti proposal

AN Innisfail woman who penned a marriage proposal to her boyfriend on the wall of a driver reviver station at Fred Drew Park lost her good behaviour bond and was fined.

Elizabeth Leeanne Kemp, 27, wrote several messages to her boyfriend on a brick wall of the Innisfail driver reviver on February 22.

The Innisfail Magistrate­s Court heard on Monday that when police arrived at the Bruce and Palmerston Highway rest area they saw the markings.

Police prosecutor Constable Corina Graudins Reid told the court that officers also saw Kemp sitting at a table next to the building.

“The defendant appeared to be upset and said she had written on the wall and intended to clean it off. However, she did not have any nail polish on

Magistrate­s Court. Yesterday it was revealed Mr Barba had only completed 43 unpaid hours since May last year.

“You’re going to have to pull your finger out by May,” Magistrate Damien Dwyer told him.

Mr Barba was released on bail.

Outside court his lawyer Campbell MacCallum told media he expected his client would finish the remaining community service by May.

“He wants to get back into playing local footy,” Mr MacCallum said. her,” Constable Reid said. “Your honour, I will mention she offered to clean the graffiti herself but still hasn’t done so.”

Kemp, who represente­d herself in court, told Magistrate Susie Warrington she didn’t have any transport to get out to the reviver station.

“I can’t go out there and walk on the highway on my own,” she said.

Magistrate Warrington took into considerat­ion Kemp’s past criminal history.

“Now I did take into account … that you were offering to remove it but I’m told you haven’t gone back and done that,” she said. “I’ve (also) taken into account that you were on a good behaviour bond so you should’ve been on your best behaviour.”

Kemp was fined $350 for the charge of wilful damage by graffiti and forfeited her $500 good behaviour bond.

A conviction was recorded.
