Duo to go to trial on wounding

TWO Toowoomba men accused of a violent home invasion type incident at a Wilsonton Hts home are to stand trial.

Benjamin John Woodhouse, 26, and Kerry Junior Diefenbach, 18, are each charged with entering a dwelling with intent by break, assault occasionin­g bodily harm in company, and unlawful wounding arising from the alleged incident on February 19.

During separate appearance­s before Toowoomba Magistrate­s Court yesterday, the pair through their respective legal representa­tives consented to their matters going to the District Court for trial - Woodhouse by full hand-up committal and Diefenbach by registry committal.

Solicitor Brad Skuse, applying for bail for his client Woodhouse, told the court there was some confusion over the facts of the case.

He said it was claimed his client had a knife but submitted it was Diefenbach who was armed at the time and who had ripped off a screen door.

Mr Skuse submitted who had done what would be an issue at trial.

Diefenbach remained on bail with strict conditions, while Woodhouse, who had been held in custody since the incident, was granted bail once the present term he was serving was completed.

Woodhouse pleaded guilty to unrelated offences of receiving a stolen credit card which he used on three occasions to obtain $140 worth of goods, and receiving stolen goods which he pawned at Cash Converters.

Magistrate Damian Carroll noted the 26-year-old’s six pages of criminal history and sentenced him to four months in jail to be released on parole after one month on June 19.

Both men will stand trial on the home invasion charges in Toowoomba District Court at a date to be set.
