“I would find it difficult to be persuaded that because a particular defendant took an incorrect view about what the position was in relation to their obligations … to bail … that they can show cause,” Mr Pinder said. “If that was the case, no one would ever be dealt with for failing to appear.”
Mr Pinder said that every bail undertaking had a notice that clearly set out the obligations. “And he’s a gentleman that purports to hold some legal qualification,” he said.
Mr Mirotsos handed himself into the Cairns police station and appeared back in court yesterday afternoon pleading guilty to two counts of breaching bail.
He was fined $500, no convictions were recorded and he was released on bail with residential conditions.
The court was told that the fraud charges would proceed via a registry committal.
