Hearing adjourned for murder accused
MURDER accused Jacob Allan remains scheduled to face the Wangaratta Supreme Court on January 30 next year, to stand trial over the death of Russell Berry on May 25 last year.
A mention hearing listed in Melbourne Supreme Court on Friday, before Justice Lex Lasry, was adjourned until December 12.
Allan, of Wangaratta, has indicated that he will plead not guilty.
During a committal hearing at Wangaratta Magistrate’s Court in April the court heard that Mr Berry, 41, of Wangaratta, was involved in a brawl in White Street on the night of May 20 last year that eventually claimed his life.
Mr Berry and several friends were involved in an altercation with Allan and his cousin Christopher Meaney, and the court was told Allan punched Berry to the head, causing him to fall to the ground, where Allan allegedly stomped on his head and chest.
Mr Berry died in hospital five days later.
