Hear­ing ad­journed for mur­der ac­cused

MUR­DER ac­cused Ja­cob Al­lan re­mains sched­uled to face the Wan­garatta Supreme Court on Jan­uary 30 next year, to stand trial over the death of Rus­sell Berry on May 25 last year.

A men­tion hear­ing listed in Mel­bourne Supreme Court on Fri­day, be­fore Jus­tice Lex Lasry, was ad­journed un­til De­cem­ber 12.

Al­lan, of Wan­garatta, has in­di­cated that he will plead not guilty.

Dur­ing a com­mit­tal hear­ing at Wan­garatta Mag­is­trate’s Court in April the court heard that Mr Berry, 41, of Wan­garatta, was in­volved in a brawl in White Street on the night of May 20 last year that even­tu­ally claimed his life.

Mr Berry and sev­eral friends were in­volved in an al­ter­ca­tion with Al­lan and his cousin Christo­pher Meaney, and the court was told Al­lan punched Berry to the head, caus­ing him to fall to the ground, where Al­lan al­legedly stomped on his head and chest.

Mr Berry died in hos­pi­tal five days later.
