Millions drags breeder to court

- LEA EMERY

FIVE racehorses are at the centre of a legal stoush between Magic Millions and a thoroughbred breeder after more than $581,000 was left unpaid.

The new owner claims he purchased the horses for a Chinese buyer who never paid up.

Magic Millions is suing Chevaux Bloodstock and director John Crowley in the Southport District Court, claiming the company never paid for the horses in full.

In court documents, Gold Coast-based Magic Millions claims the horses were purchased by Mr Crowley and Chevaux Bloodstock at the June 2018 Gold Coast National Yearling Sale.

The horses were purchased for a total of $750,225.

The horses are by Exceed and Excel, So You Think, Zoustar, Rubick and Fastnet Rock.

However, according to court documents, Chevaux Bloodstock and Mr Crowley only paid $263,975 to Magic Millions.

“(Chevaux Bloodstock and Mr Crowley) took delivery of the horses but failed to pay the full purchase price or complete the purchase of the horses by paying the full purchase price of $750,225 within 60 days,” the court documents say.

Magic Millions are also claiming they are owed more than $37,000 in interest from the unpaid fees.

Court documents allege Chevaux Bloodstock and Mr Crowley agreed that, if payment was not made within 60 days, they would have to pay interest at 1.25 per cent.

Mr Crowley told the Bulletin on Friday that he was aware of the court proceedings and that he had been asked to purchase the horses for a Chinese buyer.

“The Chinese people were going to pay for the horses but have not,” he said.

“They have not been answering their phones in the past two weeks.”

Mr Crowley said they had “three nice racehorses that have not been allowed to race”.

Chevaux Bloodstock and Mr Crowley are yet to file a response.

Magic Millions declined to comment.
