Undergoing FDR

Unless there is a risk to the children’s welfare, grandparen­ts first need to go through a process called family dispute resolution (FDR).

“This is facilitate­d by a trained FDR practition­er, who will determine whether all parties involved can find a mutually agreeable solution,” says Catherine.

If there’s no success, you’ll be issued with a certificat­e allowing you to make an applicatio­n to court. This provides you with a first court date, when the children’s parents can detail why they don’t want you involved. Next, a family report is usually prepared.

“A court-appointed social worker or psychologi­st will investigat­e the circumstan­ces behind, and history of, the relationsh­ip between the grandparen­ts, their children and the grandchild­ren,” says Catherine.

The court will use this non-biased report to help decide the outcome, and the best interests of the children is of paramount considerat­ion. This process could cost upwards of $10,000 and may take 12 months or more if there is no negotiated settlement along the way.
