Undergoing FDR
Unless there is a risk to the children’s welfare, grandparents first need to go through a process called family dispute resolution (FDR).
“This is facilitated by a trained FDR practitioner, who will determine whether all parties involved can find a mutually agreeable solution,” says Catherine.
If there’s no success, you’ll be issued with a certificate allowing you to make an application to court. This provides you with a first court date, when the children’s parents can detail why they don’t want you involved. Next, a family report is usually prepared.
“A court-appointed social worker or psychologist will investigate the circumstances behind, and history of, the relationship between the grandparents, their children and the grandchildren,” says Catherine.
The court will use this non-biased report to help decide the outcome, and the best interests of the children is of paramount consideration. This process could cost upwards of $10,000 and may take 12 months or more if there is no negotiated settlement along the way.
