Man penalised for selling farm that does not belong to him

ABU DHABI: The Abu Dhabi Appellate Court upheld the ruling of the Court of First Instance, obligating a man to pay another Dhs10,000, after the second sold a farm to the first, and it turned out that it was not his farm.

Details date back to an earlier time when the plaintiff filed a lawsuit in which he demanded the other man to pay him Dhs53,000, besides an interest of 12%, the lawsuit’s expenses and attorney’s fees.

The plaintiff indicated that the suspect sold him a farm he did not own, and that he paid him Dhs10,000.

The Court of First Instance obligated the suspect to pay the plaintiff Dhs10,000 and an interest of 4% from the date of filing the lawsuit until full payment. It also obligated him to pay the case fees and expenses.

The plaintiff appealed the ruling, noting that he had bills for the purchase of building material for the establishm­ent of a barn, and that the suspect leased him half of the farm, although he did not own it and was not entitled to rent it.

On the other hand, the suspect demanded that the appeal be dismissed.

Recently, the Abu Dhabi Court of Cassation upheld a judgment that obligated a yacht’s owner to pay compensati­on of Dhs2.058 million to the insurance company, which compensate­d a number of yachts damaged by a fire caused by the first yacht.

Earlier, the insurance company filed a lawsuit demanding that the defendant pay it Dhs2.301 million, which it paid to others as a compensati­on for damage incurred by their yachts because of a fire that erupted in the defendant’s yacht.

It also said that the insurance company got final rulings that proved the defendant’s liability for the fire and its effects. According to the official reports, the fire spread to the dock, damaging other yachts which were anchored there. The company had to pay compensati­on to them, as they were insured by it.
