Man asked to return Dhs2,000 to woman

ABU DHABI: Abu Dhabi Family, Civil and Administra­tive Cases Court obligated a man to return Dhs2,000 to a woman.

The details of the case date back to an earlier time when a woman filed a lawsuit against a man in which she requested that he be obligated to return her Dhs2,000 that she had paid him and Dhs 2,000 in compensati­on, in addition to obligating him to pay the fees and expenses of the lawsuit.

She said that she had seen an advertisem­ent on a social networking site to finalise government transactio­ns, so she called the phone number atached and agreed with the replier to clear the transactio­ns of her husband and son and amend their residency status.

Then she reportedly sent him Dhs2,000, but he did not finalise the transactio­ns nor did he refund the amount.

She at ached copies of whats a pp conversati­ons between her and the appellee, and appeared in court where she adhered to her requests.

She told the court that she asked her aunt to transfer the amount to the appellee from her bank account because she did not have one at that time.

The appellee did not atend the session despite being officially notified by ans ms, and the appellant changed her statements, saying that the amount was deposited directly into the appellee’s bank account via an ATM and was not transferre­d from any account, adding that the receipt atached to the lawsuit proved that.

She added that the report she submited was still under investigat­ion.

The court explained that the conversati­ons via Whatsapp indicated that there was an agreement between the two parties to the dispute to amend the status of the appellant’s husband and son, and that it was reassured by the conversati­ons as an electronic evidence.

The court added that the a pp el lee also refrained to come to court to present his defence or refute the appellant’s claims, and that he did not provide anything indicating his exoneratio­n from the amount.

Then, the court affirmed that he owed the appellant the amount, and obligated him to pay it ater annulling the agreement between him and her.
