Court obliges firm to pay Dhs190,000 to employee

ABU DHABI: The Abu Dhabi Court of Family, Civil and Administra­tive Cases obligated an employer to compensate an employee with Dhs190,000 as he was injured due to the employer’s error, which caused him a permanent disability of 40% in the right upper arm, 50% in the left lower arm, and the ability to sit by 40%.

The details date back to the time when the employee filed a lawsuit against his employer and an insurance company, in which he requested that the two appellees be jointly obligated to pay him Dhs100,000 and a legal interest of 12%, assign forensic medicine and oblige the appellees to pay the fees and expenses and the lawyer’s fees.

The plaintiff said that he suffered an injury due to the fault of his employer who was criminally convicted.

The plaintiff’s lawyer attended the session and submitted a memorandum which included an amendment, where he demanded that the appellee pay him Dhs250,000 as compensati­on for material and moral damage.

The court stated that what is confirmed from the forensic medical report, which the court is reassured by, is that the plaintiff’s injury became permanent and that it has caused him a permanent disability, as mentioned in the medical report, and injuries to the chest and abdomen, with which the court believed that the amount of Dhs190,000 is sufficient compensati­on for all damages.

As for the insurance company, the court rejected the case against it.

Recently, the Abu Dhabi Court for Family and Civil and Administra­tive Cases rejected a lawsuit filed by an employee of a company in which he demanded to obligate his colleague to pay him Dhs570,000, and a delay interest of 12% from the date of the claim until full payment.

He also asked the court to view the Whatsapp chats between them and get the appellee to swear that he did not get the amount claimed from him. The appellant also demanded that the appellee be obligated to pay the fees, expenses, and lawyer’s fees.
