Judiciary in crisis
Practicing law in Botswana has become BHC needs painto get its ful. The troubles besieging the Judiciary over the past couple of years have made the practice of law, the art itself, unenjoyable. The skill, research and application of the rules and case law have become a secondary trade. We used to be excited with judgements from all the courts. These were instruments that drove the essence of legal practice. We never used to worry about the integrity of the system itself.
There was a semblance of independence, of course with needed improvements. We have shifted the focus and in the process tainted judiciary with party politics. This is a very sad state of affairs. The very institution that we sacrificed our lives for is sitting on shaky grounds; it’s literally sinking. I am not proud to be a lawyer at this point. I am literally going through the motions ( giving my all but expecting very little). The Judiciary is in a crisis! The art of law is compromised. We need to introspect. Where did we let it lose? What interventions do we need to put in place?
